RE: The tariff classification of electric actuators from Taiwan

Dear Mr. Tripp:

In your letter dated April 5, 2016 you requested a tariff classification ruling.

The items in question are described electric actuators Model #’s SEA 1, SEA 3, SEA 4, SEA 8, SEA 13, SEA 35, SEA 57, SEA 3-4, and SEA 4-4. Each actuator model consists of an electric motor, metal gearing, drive shaft, printed circuit board assembly that controls the operation of the electric motor, and the enclosure.

The SEA 1 incorporates an AC electric motor with an output of 5 W. The SEA 3 and SEA 4 incorporate an AC electric motor with an output of 10 W. The SEA 8 incorporates an AC electric motor with an output of 40 W. The SEA 13, SEA 35, and SEA 57 incorporate an AC electric motor with an output of 80 W. You state that the AC motors are all single phase and are not gear motors.

The SEA 3-4 and SEA 4-4 incorporate a DC motor with an output of 10 W. You state that both DC motors used in the SEA 3-4 and SEA 4-4 actuator assemblies contain brushes.

In use, the actuators are intended to be attached to various types of valves for the purpose of controlling the valve remotely. A typical usage for the electric actuators is in plumbing, HVAC, chemical, sanitary, and various industrial applications where an automated or remote actuation of the valves is required. You state the motors are not imported with a valve.

The applicable subheading for the SEA 1, SEA 3, and SEA 4 actuators will be 8501.10.4020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electric motors…: Motors of an output not exceeding 37.5 W: Of under 18.65 W: AC.” The rate of duty will be 4.4%.

The applicable subheading for the SEA 8 actuator will be 8501.40.2040, HTSUS, which provides for Electric motors…: Other AC motors, single-phase: Of an output exceeding 37.56 W but not exceeding 74.6 W: Other. The rate of duty will be 3.3%.

The applicable subheading for the SEA 13, SEA 35, and SEA 57 actuators will be 8501.40.4040, HTSUS, which provides for "Electric motors …: Other AC motors, single-phase: Of an output exceeding 74.6 W but not exceeding 735 W: Other. The rate of duty will be 4%.

The applicable subheading for the SEA 3-4 and SEA 4-4 will be 8501.10.4060, HTSUS, which provides for “Electric motors…: Motors of an output not exceeding 37.5 W: Of under 18.65 W: DC: Other.” The rate of duty will be 4.4%.
